The Medicare Part D Late Enrollment Penalty (LEP) is an amount added to your monthly Part D premium if you go without creditable prescription drug coverage for a continuous period of 63 days or more after your Initial Enrollment Period (IEP) for Medicare Part D ends. This penalty is designed to encourage beneficiaries to enroll in Part D when they first become eligible, helping to maintain a balanced risk pool within the program.
Who Gets a Part D LEP?
You may face a Part D LEP if all of the following apply:
- You become eligible for Medicare.
- Your Initial Enrollment Period for Part D ends.
- You don't join a Medicare Part D plan or a Medicare Advantage plan with drug coverage.
- You don't have other "creditable" prescription drug coverage (like from an employer or union plan) for 63 days or more in a row.
It's crucial to understand that even if you don't use prescription drugs, if you don't have creditable coverage, you could still incur the penalty.
How is the Part D LEP Calculated?
The penalty is calculated by Medicare and added to your monthly Part D premium. The formula is as follows:
- Determine Uncovered Months: Count the total number of full, continuous months you were eligible for Part D but did not have creditable prescription drug coverage.
- Subtract Extra Help Months: If you qualified for and received Medicare's Extra Help (Low-Income Subsidy) during any of those uncovered months, those specific months do NOT count toward your penalty. Subtract them from your total uncovered months.
- Calculate Penalty Percentage: Multiply the remaining number of uncovered months (after subtracting Extra Help months) by 1%. For example, if you had 15 uncovered months, your penalty percentage is 15%.
- Apply to NBBP: Multiply this percentage by the National Base Beneficiary Premium (NBBP) for the current year. The NBBP is a standard amount that Medicare determines annually and can change each year.
- Round to Nearest Dime: The final calculated amount is then rounded to the nearest $0.10.

Once you incur the penalty, you generally pay it for as long as you have Medicare Part D. It's added to your monthly premium, regardless of which Part D plan you choose.
What is "Creditable Coverage"?
Creditable coverage is prescription drug coverage from another source (like an employer or union health plan, TRICARE, or the VA) that Medicare determines to be as good as or better than the standard Medicare Part D benefit. Your plan provider is required to notify you annually if your coverage is creditable. Keep these notices!
What is Extra Help (LIS)?
Extra Help is a Medicare program that helps people with limited income and resources pay for Medicare prescription drug costs. If you qualify for and receive Extra Help, any months you were without creditable drug coverage while on Extra Help do not count towards your Part D LEP calculation.
How to Avoid the Part D LEP
- Enroll on Time: Join a Medicare Part D plan when you first become eligible for Medicare.
- Maintain Creditable Coverage: Ensure you always have creditable prescription drug coverage, either through a Part D plan or another source like an employer or union.
- Keep Records: Save all notices from your insurance providers, especially those stating whether your drug coverage is creditable. You may need these if you appeal a penalty.
