What is Gratuity in Dubai?

Eligibility for End-of-Service Benefits
Under the New Labour Law, an employee is eligible for gratuity if they have completed at least one year of continuous service with the employer. This applies to both limited and unlimited employment contracts. The calculation is based on the employee's last basic salary.
How is Gratuity Calculated in Dubai?
The calculation of gratuity depends primarily on the length of continuous service. The New Labour Law has simplified some aspects, notably removing the reduction in gratuity for employees who resign from unlimited contracts after completing one year of service. The calculation is always based on the employee's basic salary, excluding allowances such as housing, transport, or utilities.
Service Period Less Than One Year
If an employee's continuous service period is less than one year, they are generally not entitled to any end-of-service gratuity.
Service Period Between One and Five Years
For employees who have completed one year but less than five years of continuous service, the gratuity is calculated at:
- 21 days' basic salary for each year of service.
- Fractions of a year are calculated proportionally.
Service Period Five Years or More
For employees who have completed five years or more of continuous service, the gratuity is calculated at:
- 21 days' basic salary for each of the first five years of service.
- 30 days' basic salary for each additional year of service thereafter.
- Fractions of a year are calculated proportionally for both periods.
The total end-of-service gratuity shall not exceed the basic salary of two years.
Important Considerations:
- Basic Salary: Gratuity is calculated solely on the basic salary, not the gross salary (which includes allowances).
- Unpaid Leave: Any days of unpaid leave are excluded from the service period when calculating gratuity.
- Termination Reasons: While the New Labour Law largely removes the distinction for resignation vs. termination by employer for employees completing 1+ year, gratuity can be forfeited in cases of gross misconduct as specified in Article 44 of the law. However, for standard termination or resignation, the above rules apply.
- Maximum Cap: The total gratuity cannot exceed the employee's basic salary for two years.
